Terms and Conditions for Maldives Holiday Experts

Customer

Effective Date: 05/02/2025

This Customer Agreement (“Agreement”) is made and entered into by and between Maldives Tour Guide Pvt Ltd (the company that manages and owns Maldives Holiday Experts (“MHE”) and its website: www.maldivesholidayexperts.com), and you (“Customer”) concerning your use of MHE’s services, including booking products and services through MHE’s website. By making a booking or using MHE’s services, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.

 

1. Booking and Payment

Accuracy of Information

The Customer agrees to provide accurate, complete, and up-to-date information when making a booking. MHE is not responsible for any issues arising from incorrect or incomplete information provided by the Customer.

Booking Confirmation

All bookings are subject to availability and confirmation by MHE. A booking is considered confirmed only when the Customer receives a confirmation email or notification from MHE.

Payment Terms

Payment for bookings must be made through the methods provided by MHE at the time of booking. Prices for products and services are as displayed on MHE’s website and are subject to change without prior notice. Once a booking has been confirmed, the price will not change unless modified by the Customer.

Additional Charges

The Customer acknowledges that MHE may charge additional fees such as taxes, service charges, or payment processing fees. Any additional fees will be clearly displayed at the time of booking.

2. Cancellation and Refund Policy

Customer Cancellation

The Customer may cancel bookings subject to the cancellation policy specified for the particular product or service on MHE’s website. Cancellation requests must be made through MHE’s website or by contacting MHE’s customer service. Refunds for cancellations will be processed according to the cancellation policy specified at the time of booking, which may include cancellation fees.

Supplier Cancellation

In the event that a Supplier cancels a booking, MHE will inform the Customer as soon as possible. The Customer will have the option to reschedule the booking or receive a full refund.

No-Shows

Failure to arrive at the designated time and location without prior notification will be considered a no-show. No refunds will be provided for no-shows.

Refund Processing

Refunds will be processed using the original payment method. Processing times may vary depending on the payment provider.

3. Customer Responsibilities

Legal Compliance

The Customer agrees to comply with all laws, regulations, and requirements applicable to the use of the products and services. The Customer is responsible for obtaining all necessary travel documents, including passports, visas, and permits.

Timeliness

The Customer is responsible for arriving on time and at the designated location for any booked services. MHE is not liable for any loss or expense due to the Customer’s late arrival or failure to arrive.

Behavior

The Customer agrees to conduct themselves in a respectful and lawful manner. MHE reserves the right to terminate services without refund if the Customer engages in unlawful, offensive, or dangerous behavior.

4. Liability

MHE’s Role

MHE acts as an intermediary between the Customer and the Suppliers of the products and services. MHE is not liable for any acts, omissions, errors, misrepresentations, warranties, breaches, or negligence of any Supplier.

Limitation of Liability

To the maximum extent permitted by law, MHE’s total liability to the Customer shall not exceed the total amount paid by the Customer for the applicable booking. MHE is not liable for any indirect, consequential, exemplary, incidental, or punitive damages.

Customer’s Risk

The Customer acknowledges that participation in certain activities may involve risk. The Customer assumes all risk associated with the activities and agrees to hold MHE harmless from any claims arising from such risks.

5. Force Majeure

Definition

MHE shall not be liable for any failure or delay in performing its obligations due to events beyond its reasonable control. Such events include, but are not limited to, acts of God, war, terrorism, civil unrest, natural disasters, pandemics, or any other unforeseen circumstances.

Consequences

In the event of a force majeure, MHE will make reasonable efforts to reschedule or refund affected bookings. MHE is not responsible for any additional costs incurred by the Customer due to a force majeure event.

6. Use of Photos and Videos

Consent

The Customer consents to MHE taking photos or videos during the provision of services for promotional purposes. Promotional uses include, but are not limited to, MHE’s website, social media, advertisements, and other marketing materials.

Opt-Out

The Customer may opt-out of photo or video usage by notifying MHE in writing prior to the provision of services.

Rights

MHE may modify or edit the photos and videos as necessary for promotional purposes. The Customer waives any rights to royalties or compensation for the use of such photos and videos.

7. Privacy and Data Protection

Compliance

MHE respects the privacy of Customers and is committed to protecting personal data in accordance with applicable laws.

Data Collection

MHE will collect, use, and disclose personal information as described in its Privacy Policy, which is incorporated into this Agreement by reference.

Third-Party Disclosure

Personal information may be shared with Suppliers solely for the purpose of fulfilling the booking.

8. Governing Law

This Agreement and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Maldives.

9. Dispute Resolution

Initial Resolution

In the event of any dispute, claim, question, or disagreement arising from or relating to the Agreement, the customer must raise such concerns to the related party within 3 days of the service, the parties shall use their best efforts to settle the dispute amicably.

Arbitration

If the parties do not reach an amicable settlement within a reasonable period, the dispute shall be referred to and finally resolved by arbitration in accordance with the laws of the Maldives. The decision of the arbitrator(s) shall be final and binding.

10. Amendments

Right to Modify

MHE reserves the right to modify this Agreement at any time without prior notice.

Notification of Changes

Any changes to the Agreement will be effective immediately upon posting on MHE’s website.

Acceptance of Changes

The Customer’s continued use of MHE’s services after any modification constitutes acceptance of the revised Agreement.

11. Entire Agreement

This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements between the parties.

12. Severability

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Waiver

No Waiver

No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term. The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver of such provision.

15. Complaints and Dispute Resolution

Customer Complaints

If the Customer has any complaints or disputes regarding the services received, they must inform MHE in writing within 3 days after the service.

Investigation

MHE reserves the right to investigate any complaint and may, at its discretion, offer a refund or other compensation.

Final Decision

The decision of MHE regarding any complaint or dispute is final and binding.

16. Insurance

MHE recommends that the Customer obtains adequate travel insurance to cover cancellations, medical expenses, personal accident, personal property, and other risks.

17. Indemnification

The Customer agrees to indemnify and hold harmless MHE, its affiliates, and their respective directors, officers, employees, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with the Customer’s use of the services.

18. Prohibited Activities

Customer’s Conduct

The Customer agrees not to engage in any activities that may harm MHE’s interests, including but not limited to:

  • Posting or transmitting any unlawful, threatening, defamatory, obscene, or otherwise objectionable information.
    Violating any applicable laws or regulations.
    Misrepresenting identity or affiliation with any person or entity.
    Engaging in fraudulent activities.

19. Age and Responsibility

Legal Authority

The Customer represents and warrants that they are at least 18 years of age and possess the legal authority to enter into this Agreement and to use the services in accordance with all terms and conditions herein.

Responsibility for Minors

If the Customer is booking services on behalf of minors, they accept full responsibility for supervising and ensuring compliance with this Agreement.

20. Acceptance

Acknowledgment

By completing a booking through MHE’s website or services, the Customer acknowledges and agrees to the terms and conditions set forth in this Agreement.

Maldives Holiday Experts Supplier Agreement

This Supplier Agreement (“Agreement”) is made and entered into by and between Maldives Tour Guide Pvt Ltd (the company that manages and owns Maldives Holiday Experts (“MHE”) and its website: www.maldivesholidayexperts.com), and the service provider (“Supplier”) for the provision of products and services through MHE’s website. By using MHE’s services, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement.

1. Listing and Pricing

  • The Supplier agrees to list their products and services on MHE’s website at the agreed-upon rates.
  • The Supplier is responsible for ensuring the accuracy of all information provided.
  • The Supplier acknowledges that MHE reserves the right to adjust prices for promotional purposes.

2. Booking and Payment

  • The Supplier agrees to accept bookings made through MHE’s website.
  • MHE will facilitate payment to the Supplier for confirmed bookings.
  • The Supplier acknowledges that payment processing fees may apply.

3. Cancellation Policy

  • The Supplier agrees to adhere to the cancellation policy as specified on MHE’s website.
  • The Supplier will notify MHE of any changes or cancellations via email or phone.
  • Cancellation fees may apply, as specified by the Supplier.
  • The Supplier acknowledges that MHE is not responsible for any cancellation fees.

4. Liability

  • The Supplier shall be liable for any damages or losses arising from their failure to provide the booked products and services.
  • MHE agrees to hold the Supplier harmless from any claims or damages arising from MHE’s actions or omissions.
  • The Supplier acknowledges that they are responsible for any personal injury, property damage, or any other incident that may occur during the provision of products and services.

5. Use of Photos and Videos

  • The Supplier grants MHE the right to use any photos and videos provided by the Supplier for promotional purposes, including but not limited to, the MHE website, website articles, social media, advertisements, and any other marketing materials.
  • The Supplier acknowledges that MHE may modify or edit the photos and videos to fit the marketing materials.
  • The Supplier agrees to provide MHE with any necessary permissions or releases for the use of the photos and videos.

6. Withdrawal of Payment

  • The Supplier may withdraw payment 5 days after providing the service to the customer, subject to the terms and conditions of this Agreement.
  • If the Supplier withdraws payment, MHE will not be liable for any payment to the Supplier for the withdrawn payment.

7. Dispute Resolution

  • If a customer files a complaint or dispute within 3 days after the service, MHE reserves the right to investigate the matter.
  • Based on the findings of the investigation, MHE may refund the customer in whole or in part, as deemed appropriate.
  • The Supplier acknowledges that MHE’s decision regarding the dispute resolution is final and binding.

8. Governing Law

  • This Agreement shall be governed by and construed in accordance with the laws of the Maldives.
  • Any disputes arising from this Agreement shall be resolved through arbitration in the Maldives.

9. Amendments

  • MHE reserves the right to modify this Agreement at any time without prior notice.
  • The Supplier’s continued use of MHE’s services after any modification constitutes acceptance of the revised Agreement.

10. Force Majeure

  • Neither party shall be liable for any failure to perform its obligations under this Agreement if such failure results from circumstances beyond its reasonable control, including but not limited to, acts of God, war, civil unrest, natural disasters, or any other unforeseen circumstances.

11. Entire Agreement

  • This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, understandings, and agreements between the parties.

12. Severability

  • If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be severed from the Agreement, and the remaining provisions shall remain in full force and effect.

13. Waiver

  • The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver of such provision or of the right of such party to enforce such provision.

14. Confidentiality

  • The Supplier agrees to maintain the confidentiality of all information provided by MHE, including but not limited to, customer information and payment details.

15. Indemnification

  • The Supplier agrees to indemnify and hold harmless MHE, its affiliates, and their respective directors, officers, employees, agents, suppliers, licensors, vendors, distributors, and service providers from and against any and all claims, losses, liabilities, damages, fines, penalties, settlements, expenses, and costs (including attorneys’ fees and court costs) incurred or suffered by MHE in connection with any third-party claim, suit, demand, action, or investigation brought against MHE directly or indirectly arising out of or relating to the Supplier’s activities, operations, products, or services.

16. Termination

  • Either party may terminate this Agreement upon written notice to the other party.
  • Upon termination, the Supplier shall immediately cease all access to and use of MHE’s services and return all Confidential Information of MHE.

17. Dispute Resolution

  • Any controversy, claim or dispute arising out of or relating to this Agreement, or the breach, termination or invalidity thereof, shall be settled exclusively in accordance with the laws of the Maldives.

Acceptance

This Agreement is effective as of the date of acceptance by the Supplier and shall remain in effect until terminated by either party in accordance with the terms and conditions set forth herein.

Supplier Acceptance

By clicking the “I Accept” button, the Supplier accepts this Agreement and agrees to the terms and conditions set forth herein.

MHE Acceptance

Maldives Tour Guide Pvt Ltd, on behalf of Maldives Holiday Experts (MHE), accepts this Agreement and agrees to the terms and conditions set forth herein.
